Terms and Conditions
These Terms and Conditions (“Agreement”) govern the use of the repairs and maintenance service (“Service”) provided by Country Builders (“Company,” “we,” “our,” or “us”). By subscribing to and using the Service, you (“Subscriber,” “you,” or “your”) agree to abide by these terms and conditions. Please read these terms carefully before subscribing to the Service.
1. Subscription Service
- Subscription Fee: The Service is available for a weekly subscription fee of $25 (AUD). This fee is subject to change at the discretion of the Company with prior notice to the Subscriber. In consideration for the Company providing services as required at the nominated property for a period of one year, You agree to pay the Company a non-refundable fee of $25 (AUD) including GST, per month for 12 months.
- Billing Cycle: The subscription fee is charged monthly, and the payment will be direct debited from the payment method you provide during the sign-up process.
2. Scope of Service
- Service Inclusions: The parties acknowledge that the Company is obligated is to provide labour only, and that the Landlord must pay the cost of any equipment or materials required. For the avoidance of doubt, presentation of a valid tax invoice in relation to a particular material or equipment will be considered proof of the cost of those funds and that they are owed to the Company.
- Covered Services: The Service includes repairs and maintenance for 8 hours of labour over a 12 month period which can be used across the following services. The types of covered services may include carpentry, plumbing, electrical, roofing, handyman work, or minor repairs. 8 hours of labour must be utilised within the 12 month period from commencement date, the labour will not roll into the next 12 month period.
- Exclusions: Any material, part, item which needs to be purchased or hired, major extension/renovation, roofing, plumbing or electrical work
- Service Requests: Subscribers may request a repair or maintenance visit by contacting our customer service team. We aim to fulfill all requests within a reasonable time frame, subject to availability and the nature of the issue.
- Job Completion: The Company will provide a report or photos detailing the works conducted at the property to the Landlord or Real Estate Agent
3. Subscriber Responsibilities
- Accurate Information: You must provide accurate and complete information when subscribing to the Service. Failure to do so may affect the fulfillment of services.
- Access to Property: You agree to provide the Company’s service tradespeople reasonable access to your property to perform the necessary repairs and maintenance.
4. Cancellation and Termination
- Cancellation by Subscriber: You may cancel your subscription by notifying us through the customer service channel. Please note as per clause 1, You are required to pay out the 12 month subscription, unless agreed by both parties otherwise.
- Termination by Company: The Company reserves the right to terminate or suspend your subscription at any time if you violate the terms of this Agreement, provide false information, or for any other reason deemed necessary by the Company.
- Refunds: The parties agree that notwithstanding any other provision of this contract, the Company may at any time determine that it is unable to provide maintenance services to the Landlord at the Property and will refund a proportion of the fee paid to it, calculated on a pro rata basis
5. Payment and Billing
- Payment Method: You must provide a valid credit card or other accepted payment method to activate your subscription. You authorise the Company to charge the recurring weekly subscription fee to your payment method.
- Late Payments: If payment is not received by the Company, we may suspend or cancel your Service. We may also charge late fees in accordance with applicable laws.
- Refunds: Subscriptions are non-refundable. If you cancel your subscription, you will not receive a refund for any unused portion of the current billing cycle.
6. Limitation of Liability
- No Warranty on Repairs: While the Company aims to provide high-quality service, we do not warrant or guarantee the outcome of any repair or maintenance performed.
- Public Liability: The Company undertakes to maintain public liability insurance in the amount of at least $20,000,000.00 (Twenty Million Dollars) throughout the course of the contract. A copy of Public Liability Insurance can be obtained on request.
7. Privacy and Data Collection
- Data Collection: By subscribing, you consent to the collection of personal information necessary to provide the Service. This may include your contact details, address, and details of your maintenance and repair history.
- Privacy Policy: For information on how we collect, use, and protect your personal information, please refer to our Privacy Policy.
8. Changes to Terms
- The Company reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to you in advance. By continuing to use the Service after changes are made, you agree to the updated terms.
9. Governing Law
- This Agreement shall be governed by and construed in accordance Australian Consumer Law
